Intellectual property and copyright

All content on this site, including the photographs, images, written text, guide articles, graphics, logos, the One Burning Lamp name, and the design, is the original work of One Burning Lamp and its photographers, Nikholas Novachuk and Brett Hill, and is protected by United States and international copyright and trademark law. All rights are reserved.

Except as we permit in writing, you may not copy, download, reproduce, republish, distribute, modify, create derivative works from, publicly display, sell, or otherwise exploit any content. You may not remove or alter any copyright notice or watermark. You may not use automated means such as scraping, crawling, or data mining to collect content, and you may not use any content to develop, train, or provide data to any artificial intelligence, machine learning, or generative model or dataset. These restrictions apply to commercial and non-commercial use alike.

You may view the site and share links to it for personal, non-commercial purposes. Any other use requires our prior written permission. To request a license, email info@oneburninglamp.com.

Pricing, packages, and the photography contract

Any pricing, packages, or service descriptions shown on the site are provided for general reference only. They are not an offer or a binding commitment, they depend on availability, and they may change at any time without notice. Using the site or submitting an inquiry does not create a booking or a contract.

All photography services are governed by a separate written agreement signed by you and One Burning Lamp. If anything on the site conflicts with that signed agreement, the signed agreement controls.

Acceptable use

You agree to use the site only for lawful purposes. You agree not to break the law, attempt to gain unauthorized access to the site or its systems, introduce malware, interfere with the site's operation, use bots or scrapers other than standard search-engine indexing, misuse the inquiry form with false information or spam, or collect information about other visitors.

THE SITE AND ALL CONTENT ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the site will be uninterrupted, error free, or secure, or that any information on it is accurate, complete, or current. Our guide articles are general information, not professional advice. Our photographs show our style and do not guarantee any particular result for your event.

Limitation of liability

To the fullest extent permitted by law, One Burning Lamp, its photographers, and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your access to or use of, or inability to use, the site or any content, even if advised of the possibility of such damages. Our total liability for any claim relating to the site will not exceed one hundred US dollars. Nothing in these Terms limits liability that cannot be limited under applicable law.

The site may contain links to third-party websites or services that we do not own or control, such as social media and referenced resources. We provide these links for convenience only, do not endorse them, and are not responsible for their content, accuracy, or practices. Accessing third-party sites is at your own risk and subject to their terms.

Copyright complaints

We respect intellectual property rights. If you believe content on the site infringes your copyright, email a written notice to info@oneburninglamp.com that identifies the copyrighted work, identifies the material in question and where it appears on the site, provides your contact information, states that you believe in good faith the use is not authorized by the copyright owner or the law, and states under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the site will be brought exclusively in the state or federal courts located in Arizona, and you consent to the personal jurisdiction and venue of those courts.

Changes to these Terms

We may update these Terms from time to time. The date above shows when they were last revised. Changes take effect when posted, and your continued use of the site after changes are posted means you accept the updated Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and One Burning Lamp regarding your use of the site. They do not affect any separate signed photography agreement, which governs photography services.
